A conservatorship is a way to protect your vulnerable loved one from decisions that they would not make but for their frailty and to allow you to take actions that they cannot take due to their physical condition. It provides for their safety and your peace of mind.

Petitioning for a conservatorship be fairly straightforward, but it is extremely important that everything be done exactly correctly. If it is not, the Court may be required to dismiss the petition or at the very least delay in acting. After a conservatorship is granted it is extremely important that the person appointed know exactly what their responsibilities are and this is best discussed with an experienced attorney who regularly handles conservatorships.

Do Conservatorships Require a Trial?

Most but not all petitions for a conservatorship do not involve a trial. There is a hearing that is required. In the hearing, medical evidence, a report of the Guardian ad Litem and other evidence will be presented to the Court. A trial is required if the person who is the subject of the petition for conservatorship does not agree to the appointment of the conservator or the other terms of the conservatorship.
